Sampling of cases as prosecutor

As a Deputy District Attorney assigned to the hardcore gang and career criminal divisions of the Los Angeles County District Attorneys’ Office, and Chief Assistant Prosecutor, I prosecuted criminal street gang members and career criminals who committed murder and other serious crimes. These cases were vertically prosecuted and often involved special circumstances which exposed the accused to death or life imprisonment without the possibility of parole.
Gang, weapon, and other sentencing enhancements usually were charged. Usually, the cases involved multiple counts, defendants and victims, witness intimidation, complex evidentiary issues and difficult fact patterns. Occasionally, two juries were required to accommodate confessions/admissions which also implicated co-defendants. Occasionally, the insanity defense was asserted.

The defendant, a criminal street gang member who recently had been released from prison for manslaughter, entered a public park and ordered three teenaged boys and their girlfriends to leave. After resistance from the boys, the defendant shot two of them in the face and head at close range. He shot the third victim who survived the attack. Two weeks thereafter, taking them by surprise, the defendant shot a husband and wife while visiting their home. The defendant believed the couple provided information to law enforcement about the park murders.
The defendant was a member of the Mexican Mafia “EME. Throughout the pendency of the trial, he ordered that any witnesses be killed. Many attempts were made on a chief witness who was housed with the department of corrections. After being transferred to Los Angeles County for testimony, the sheriff had great difficulty protecting the witness from the defendant’s escalated efforts to prevent his testimony. After conviction and return of the defendant to the department of corrections, he murdered another inmate.

Defendant Holmes was terminated from his job at a Shoney’s Restaurant after getting into an argument with a co-worker. At closing, he waited in the parking lot with the co-defendant. As the victims exited, the defendants trapped them in the restaurant’s foyer. The brutal assault resulted in the victims being stabbed numerous times. One victim, who weighed approximately 135 pounds, was tortured with a butcher’s knife by defendant Holmes who weighed approximately 190 pounds. This victim’s hands and arms were pinned behind him by the co-defendant who weighed approximately 200 pounds. The defendant was sentenced to death by the court after the jury was hung during the penalty phase of the trial. The matter was prosecuted during my tenure as Chief Assistant Prosecutor for the Marion County (Indianapolis, IN) Prosecutor’s Office.

The case involved the protracted brutal beating of a husband and wife during the presence of the victims’ minor children. The injuries to the victims involved multiple fractures to the skulls and almost complete displacement of the scalp of each victim. The murders were motivated by a money dispute.

The defendant, a member of a criminal street gang, was the shooter in a drive-by shooting death of a victim who was perceived as a rival gang member. After confronting the victim, the defendant asked the driver “should we shoot him.” The victim responded “what do you want to shoot me for?” The defendant then shot the victim several times at close range.

This matter involved a “murder for hire” where the killer from California, traveled to Indiana to execute the victim who was shot numerous times. The bullets recovered from the victim’s body matched the firearm found in the defendant’s possession. A key witness was transported from a federal prison in California to Indiana.

The case involved 6-8 criminal street gang members who “rat packed” the victim, a young marine, who was home on leave. The victim was stabbed 21 times by the group who “claimed” the neighborhood. They resented not being invited to a private party being held at the complex where the slaying occurred. The matter was extremely difficult to prosecute because of witness identification and intimidation issues.
